The Esplendor Conduct Rules require that owners obtain permission from the Board of Trustees for the keeping of pets. This is done in the interest of promoting harmonious living and in the interest of animal welfare. The rules regulating the keeping of pets are set our below:
- An owner or occupier of a section shall not, unless the trustees have granted prior written consent, keep any animal, reptile or bird in any circumstances in a section or on the common property. The Trustees may, however, withdraw the permission should any condition laid down during approval not be adhered to or ignored.
- When granting such approval, the trustees may prescribe any reasonable condition.
- Dogs/cats must be of such a height & weight as well as nature to be suited for living in small areas.
- Any owner or occupier who wishes to keep an animal as defined herein must make written application to the trustees prior to such animal being acquired. Maximum of 2 pets (cats or small dog breeds only) per unit.
- Any owner or occupier must ensure that their animals as defined herein are not a disturbance to other owners or occupiers. On the receipt of written complaints by two separate owners or occupiers, the trustees shall have the right to revoke such consent and request the owner to remove such animal from the complex.
- Animals shall not be permitted in or around any part of the swimming pool area.
- Dogs, which are permitted, will be controlled properly by means of a lead when they are moving about on the communal property or any section of the complex. Owners/residents who wish to keep dogs and cats must take care that sufficient precautions have been taken to ensure that dogs and cats cannot get out of their sections or the exclusive use area.
- Dogs and cats which are permitted may not dirty or damage any part of the communal property or any part of the complex at all. Should an accident occur it is your responsibility to remove it. (It is recommended that a “poop scoop” be used).
- In future, two small dogs will be permitted subject to written permission from the Trustees.
- Barking and whining dogs, especially where owners/residents are not at home, are very disruptive. Owners/residents are requested to attend to this problem, should it occur, or the Trustees will be compelled to prohibit dogs of which complaints are received.
- Owners of pets shall always take care that they obey the Animal Protection Act and should it appear that they are guilty of a crime with regards to this matter, the Trustees shall have the right to enter the particular section unhindered and at the risk of the owner/resident, whether with the representative of the authorities concerned or without them, in order to take necessary action.
- All dogs and cats must be:
Neutered/spayed and vaccinated with all relevant documentation to be attached to the application form.- Must be identifiable by a collar and identity tag with the unit number and contact telephone number.
- Have a microchip.
- A photo of the pet must be attached to the application form.
13. Should your pet attack and in the process injure a person, either on the common property or inside your unit, you will personally be held liable for any claims.
To complete your Pet Application Online or Pet Application PDF Form the Trustees require the following information:
- A clear photograph of your pet
- Proof of vaccinations of each pet
- Microchip ID number if applicable
If you are a tenant we also need a letter from your owner stating that they have approved your request to have pets.
CONDITIONS FOR DOGS
If a dog shows any signs of aggression to any resident, visitor or child, it will be required that the dog receives training and behaviour modification. This expense is for the dog owners own pocket.
Training must be continued until clearance is granted. If the dog does not receive clearance the dog must be removed from the complex immediately.
GENERAL NOTES
If a pet is deemed a nuisance as defined in the Conduct Rules, or the pet does not meet the requirements of the rules, the Body Corporate reserves the right to remove the pet to the local SPCA without further notice to the pet’s owner.
The Conduct Rules regarding Pets are strictly enforced. Please read section 19 of the Conduct Rules carefully and ensure that you understand them.
